The following are terms of a legal agreement ("Agreement") between you ("You") and Kreeda LLC ("Kreeda") as the owners and operators of this website, , the related mobile application and the services offered on these websites (collectively the "Websites"). You and Kreeda are each sometimes referred to herein as a "Party" and collectively as the "Parties." If You do not agree to any of these terms, please leave the Websites immediately as You are not authorized to use it. By accessing, browsing, and/ or using these Websites, any portions of these Websites or, the services offered on the Websites, You acknowledge that You have read, understood these terms of use and, agree to be bound and abide by them. By using these Websites, You agree to inform any end user about these terms of use including all its clauses and any limitations thereof.

Modification to This Agreement

These terms of use may be revised at Kreeda's sole discretion at any time, without prior notice. You are responsible to review the terms and conditions periodically. Your continued access and/or use of the Websites and its services following any change, constitutes Your agreement to any such revised terms of use.

1. Use of Service

1.1. Intended Audience

1.1.1 The Websites is only intended for users located in the United States. Those who choose to access these Websites from other locations assume the responsibility of complying with applicable local laws.

1.1.2 By using these Websites, You warrant that You are 18 years of age or older. The use or access to these Websites by anyone under the age of 18 is strictly prohibited and is a violation of this agreement.

1.1.3 You may use the Websites only if You are legally authorized to form a binding contract with Kreeda.

1.1.4 You may not use the Websites if You were previously removed from accessing the service.

1.2. Acceptable Use

You may not access or use the Websites or any of the related services for any other purpose other than that for which Kreeda makes it available. You may use the Websites only for lawful purposes and You agree that You shall at all times comply with all applicable local, state, provincial, national, and international laws, statutes, rules, regulations, ordinances, and the like applicable to Your use of the Websites. You also agree that You will not do any of the following under any circumstances:

1.2.1 Submit to or on the Websites, anything that is or may be: (a) harmful, threatening, abusive, harassing, degrading, hateful, or intimidating; (b) defamatory, libelous, or disparaging of any person or entity; (c) false, fraudulent, or tortious; (d) obscene, indecent, pornographic, vulgar, profane, or sexually explicit; (e) intended to promote (or have the effect of promoting) violence, racial hatred, terrorism or illegal acts; (f) infringing, or in violation or misappropriation of, any patent, trademark, trade identity right, trade secret, publicity right, privacy right, copyright, or any other intellectual property right or any other rights of any third party; (g) in violation of any other rights of any person or entity; (h) in violation of any law or regulation; or (i) otherwise objectionable.

1.2.2 Impersonate any person or entity; falsely state or otherwise misrepresent Your affiliation with any person or entity, including us; forge headers or otherwise. manipulate identifiers in order to disguise the origin of any submissions to or through the Websites; or expressly state or imply that we endorse any statement You make.

1.2.3 Violate or attempt to violate the security of any portion of the Websites, including but not limited to: (a) access content not intended for You; (b) log into a server or account which You are not authorized to access; (c) attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (d) attempt to interfere with or disrupt the Websites or the servers or networks that provide the Websites, including without limitation, via means of submitting a virus to the Websites, overloading, "flooding", "mailbombing" or "crashing" the Websites; or (e) restrict or inhibit any other user from accessing or using the Websites, including, without limitation, by means of hacking or defacing any portion of the Websites.

1.2.4 Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Websites.

1.2.5 Except as may be the result of a standard search engine or internet browser usage, using or launching, developing or distributing any automated system, including, without limitation, any spider, robot (or "bot"), cheat utility, scraper, or offline reader that accesses the Websites, or using or launching any unauthorized script or other software.

2. Customer Accounts

2.1 Account Safety

In order to use some Websites services, customers will be required to create an account. Any account created by You is meant for Your private use. You agree that it is Your responsibility to maintain the privacy of Your account details and that You will not share Your account information with others. You also agree to immediately notify Kreeda of any unauthorized use of Your password or account or any other breach of security.

You agree that You will be responsible for any charges which may arise due to the use of Your account via Kreeda's services, including charges resulting from unauthorized use of Your account.

You agree that You will be responsible and liable for any activity happening in Your account.

Kreeda will not be liable for any losses caused by any unauthorized use of Your account.

Kreeda encourages You to use a strong password (one that will include lower- and upper-case letters, numbers and symbols) to protect Your account.

3. Websites Contents and Ownership

Kreeda and the companies listed on the websites and other sources own the intellectual property rights, titles and interests of all services and information on these Websites including but not limited to the Kreeda's and Escaperoom.com name, logo, graphics, videos, audios, images, designs, photographs, writings, graphs, data, software and other materials. Kreeda's and the listed company's ownership rights are protected by copyrights, trademarks, trade secrets, or other proprietary rights. You shall comply with all copyright laws worldwide in Your use of these Websites and prevent unauthorized copying. You may not copy, display, distribute, modify, reproduce, or transmit these Websites or portions thereof without prior written consent from Kreeda. Except as provided in this Agreement, Kreeda does not grant You any expressed or implied right in or under any patents, trademarks, copyrights, or trade secret information.

4. Customer Data

4.1 By using the Website services, You assent that You own all right, title, interest, and, any intellectual property rights in any data, files, graphics, images, documentation, communication, and any other material or content (collectively "Customer Data") embedded or provided by You directly or indirectly in connection to Your use of the service.4.2 Kreeda does not claim ownership in any Customer Data provided by You. However, by submitting, uploading, posting, or transmitting Customer Data and/or personally identifiable information through the Service, You grant Kreeda a worldwide, royalty-free, non-exclusive, sublicensable license to use, distribute, reproduce, modify, adapt, create derivative works of, publish and/or translate the Customer Data in accordance with this Agreement. Kreeda also has the right to use any aggregated or anonymized data derived from Customer Data for its business purposes. You are solely responsible for all Customer Data uploaded, downloaded, posted, emailed, transmitted, stored or otherwise made available through the Service. Kreeda reserves the right to determine whether any Customer Data is appropriate and in compliance with this Agreement, and may pre-screen, monitor, filter, restrict, block, move, refuse, modify or remove Customer Data at any time in its sole discretion, without prior notice. Kreeda does not guarantee the security or availability of any Customer Data or other information transmitted or stored through the Service.

5. Fees and Payments

You acknowledge and agree that You are responsible for paying the fee that applies for each booking on escaperoom.com. You acknowledge and agree that all fees are non-cancellable and non-refundable (except as explicitly set forth herein). Upon You entering into this Agreement with Kreeda and giving Kreeda Your credit card information, You agreethat Kreeda and its escape rooms associates may, andis authorized to, charge Your credit card account for payment in advance in the correct amount, which payment may vary from time to time and from booking to booking as provided in our Websites. If Kreeda does not receive payment for Customer's booking, as required, Kreeda may suspend Your right to access the applicable service offering and/or cease accepting new orders from You and/or terminate Your account.

Your payment reconfirms Your consent to be bound by the terms of this Agreement. Fees are exclusive of any applicable sales, use, import or export taxes, duties, fees, value-added taxes, tariffs, wire or payment transfer fees, or other amounts attributable to Your execution of this Agreement or use of the Website services (collectively, "sales taxes"). You shall be solely responsible for the payment of any wire and payment transfer fees and sales taxes, provided that if any such fee or withholding tax is deducted or levied, then You shall gross up the sums paid to Kreeda so that the amount received by Kreeda after the withholding tax is deducted is the full amount Kreeda would have received if no withholding or deduction had been made. In the event Kreeda is required to pay sales taxes on Customer's behalf, Customer shall promptly reimburse Kreeda for all amounts paid. In the event that Customer is subject to invoice payments, then all such amounts shall be paid to Kreeda within thirty (30) days of the date of the invoice. Fees not paid when due shall be subject to a late fee equal to one- and one-half percent (1.5%) of the unpaid balance per month or the highest monthly rate permitted by applicable law, whichever is greater. As a further remedy for non-payment, Kreeda reserves (among other rights and remedies) the right to suspend access to the Websites.

Kreeda and its associates reserves the right to change its prices listed on the Websites and to institute new charges at any time, upon notice to You, which may be sent by email or posted to Your account. Your use of the Services following such notification constitutes Your acceptance of any new or increased charges. Any fees paid hereunder are non-refundable.

6. Term and Termination

6.1 Without limiting its other remedies, Kreeda may immediately discontinue, suspend, terminate, or block Your and any user's access to these Websites and the related services or any portion thereof at any time in Kreeda's sole discretion and without notice.

6.2 Kreeda reserves the rights to temporarily suspend access to the Website for operational purposes, including, but not limited to, maintenance, repairs or installation of upgrades.

7. Assignment

This Agreement, and any rights and licenses granted hereunder may not be transferred or assigned by You, but may be assigned by Kreeda without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

8. Modification to These Websites

Kreeda shall reserve the right at any time it may deem fit, to modify, alter, add to, terminate, and/or suspend any part or all of the Websites, or/ and any feature or service at its own sole discretion at any time, without prior notice. Kreeda will not be liable to You or any third party for any modification, alteration, addition, termination or suspensions of any service or part or all Websites.

9. Third Parties

The Websites may include links to other websites or applications operated by third parties.

Kreeda has no control over such websites and resources or their terms of use. Such hyperlinks are provided for Your reference only and their inclusion does not imply any sponsorship, affiliation, or endorsement of the material on such websites or with their operators. Material contained in linked websites does not necessarily reflect the views of Kreeda and we provide no warranty or representation in relation to the accuracy or completeness of such material. Your use of third-party websites is at Your own risk.

Kreeda may provide You with an option to purchase or access services made available by Kreeda or third parties. These options, if offered, are subject to those third parties terms of use and/ or terms of service.

10. Mobile Use

Kreeda does not represent, warrant or guarantee that all portions of Kreeda's Websites or service can be accessed via mobile devices or other devices or via all carriers and service plans.

11. Consent to Electronic Transactions and Disclosures

As Kreeda operates online, it is necessary for You to consent to transact business with us online and electronically. As part of doing business with us, therefore, we also need You to consent to us giving You certain disclosures electronically, either via our Websites, a third-party website or platform, or to the verified email address You provided during registration. By entering into this Agreement, You consent to receive electronically all documents, communications, notices, contracts, and agreements arising from or relating in any way to Your or our rights, obligations or services under this Agreement (each, a "disclosure"). This document informs You of Your rights concerning disclosures.

11.1 Electronic Communications. Any disclosures will be provided to You electronically, either on our Websites, a third-party website or platform, or via electronic mail to the verified email address You provided during registration. Your consent to electronic delivery will apply to all future communications unless consent is withdrawn by You. If You require paper copies of such disclosures, You may write to us at the mailing address provided below and a paper copy will be sent to You.

11.2 Scope of Consent. Your consent to receive disclosures and transact business electronically, and our agreement to do so, applies to any transactions to which such disclosures relate.

11.3 Consenting to Do Business Electronically. Before You decide to do business electronically with us, You should consider whether You have the required hardware and software capabilities described below.

Hardware and software requirements

11.4 In order to access and retain disclosures electronically, You must satisfy the following computer hardware and software requirements: access to the internet; an email account and related software capable of receiving email through the internet; a web browser that is SSL-compliant and supports secure sessions, and a hardware capable of running this software.

You are responsible to keep us informed of any change in Your email or home mailing address so that You can continue to receive all disclosures in a timely fashion. You also agree to update Your registered residence address, and telephone number on the Websites if they change.

You agree to print a copy of this Agreement for Your records. You agree and acknowledge that You can access, receive, and retain all disclosures electronically sent via email or posted on the Websites.

12. Escape Room Bookings via Escaperoom.com

Kreeda allows you to "Easy Book" escape rooms through its Websites. You understand that Kreeda does not operate any escape rooms or business listed on the Website, also all information listed by our partners relating to their escape room business is not under Kreeda's responsibility. When you reserve an escape room, an account will be created on the Website. Any changes such as rescheduling or cancelling a reservation shall be coordinated with the escape room and in accordance with their policies including those changes that are a result of misinformation regarding availability. Payments may be processed by either Kreeda or your booked escape room operator. You agree that if the escape room operator is to process your payment it is the escape room operator payment policy that control the payment processing and some operators will not charge for your reservation until the day of game, instead some operator might put a "hold" equal to the booking amount on your credit card. Any guarantee about price match or lower price guarantee are offered by the escape rooms operators and are under their exclusive responsibilities and are controlled by those operators terms and conditions.; in additions to those terms listed by the different escape room operators all lowest price guarantees presented on the Kreeda's website covers retail and prepaid rates available to the general public. This does not include discounts you may receive (or be eligible for) from third-party organizations such as AAA or AARP, or special offers made as part of a membership program, corporate discount, daily deal, customized deal, group or rewards program.

13. Gift Card Purchase and Redemption via Escaperoom.com

The Website offers two types of gift cards for users: the Credit Line option and the Traditional option, both redeemable exclusively on the Website and not through third-party websites or at individual escape room locations. The specific locations where these gift cards can be used are listed in the gift card redeem section on the Website.

13.1 Credit Line Option

In the Credit Line option, a Gift Card Sender authorizes a specific amount for a Gift, which does not result in an immediate charge to the Sender's credit/debit card. This option is applicable for purchases at select locations marked in the gift card redeem section on the Website, functioning as a credit line. If the Gift Card Recipient's purchase amount is less than the gift card value, only the actual amount spent is charged to the Gift Card Sender's credit/debit card. For purchases exceeding the gift card value, the gift card covers up to its limit, with any additional costs to be paid by the Gift Card Recipient. The Gift Card Sender is notified when their credit/debit card is charged. This option does not impose liability on the Gift Card Sender if the gift card is unused, subject to certain conditions and exceptions. The use of this gift card with promo codes is permitted, albeit limited to one gift card per reservation.

13.2 Traditional Option

The Traditional option works as a standard gift card. The Gift Card Sender's credit card is debited immediately for the gift card amount upon purchase. This non-expiring gift card is usable like cash at select locations indicated in the gift card redemption section on the Website. It can be combined with promo codes, but only one gift card is allowed per reservation. All purchases of Traditional option gift cards are absolutely final and non-refundable. It is the responsibility of the gift card purchaser to make sure that the gift card recipient will be able to use the gift card in one of the eligible locations as identified on the Website.

Both types of gift cards are subject to the specific booking policy of the reservation for rescheduling and cancellations. Kreeda LLC reserves the right to modify the terms of the gift card system, ensuring compliance with applicable financial and consumer protection laws. Disputes related to the gift card system will be resolved as per the process outlined in Dispute Resolution Section of this Agreement. For inquiries concerning the gift card system, customers are advised to contact Kreeda LLC using the contact form on the Website.

14. Liability Disclaimer

Kreeda makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services and related graphics contained on the Websites for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services and related graphics are provided "as is" without warranty or condition of any kind. Kreeda and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non- infringement. To the maximum extent permitted by applicable law, in no event shall Kreeda and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Websites or the participation in any games booked on escaperoom.com whether you used to Website to find a partner or not , with the delay or inability to use the Websites or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the Websites, or otherwise arising out of the use of the Websites, whether based on contract, tort, negligence, strict liability or otherwise, even if Kreeda has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to You. If You are dissatisfied with any portion of the Websites, or with any of these terms of use, Your sole and exclusive remedy is to discontinue using the Websites.

15. Assumption of Risk

You expressly agree that the use of these Websites is done at Your own risk. The information published on these Websites is for informational purposes only. Any reliance You place on such, You do at Your own risk. You understand that while great care is taken to provide You with the best information possible, Kreeda makes no representations or warranties of any kind, express or implied, about the reliability, accuracy, completeness, security, or currency of the information provided including any information listed as "verified".

16. Indemnification

You agree to indemnify, defend, and hold harmless Kreeda, its affiliates, agents, employees, and licensors from and against any and all claims and expenses, including reasonable attorney fees, arising out of or related in any way to Your use of the Websites, violation of this Agreement, violation of any law or regulation, or violation of any proprietary or privacy right.

17. Dispute Resolution

This Agreement is governed by and shall be construed in accordance with the laws of Texas, U.S.A. without reference to its conflict-of-law provisions. You agree to submit to the personal and exclusive jurisdiction in Harris County, Texas, U.S.A. for any disputes with Kreeda arising out of Your use of these Websites. You agree that if a dispute arises, parties will attempt to resolve the dispute with mediation in Harris County, Texas, U.S.A., or an online mediation service that is mutually agreed upon by all parties. The parties agree that their good faith participation in mediation is a condition precedent to pursuing other legal remedies. The successful party to any dispute resolution will be entitled to reasonable costs and fees incurred in resolving or settling the dispute, in addition to any other relief to which the party may be entitled.

18. Entire Agreement

This Agreement constitutes the entire agreement between Kreeda and You with respect to these Websites. This Agreement supersedes and cancels all prior or contemporaneous discussions, writings, negotiations, and agreements whether electronic, oral, or written between You and Kreeda with respect to these Websites. A printed version of this Agreement, and of any notice given in electronic form, shall be admissible in judicial or administrative proceedings based on or relating to this Agreement to the same extent, and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

19. Severability

If any term in this Agreement is found to be void or voidable, the remaining terms of the Agreement are unaffected and deemed to remain in full force and effect, including those terms that are similar.

20. No Waiver

Kreeda's failure to enforce its rights under this Agreement, or take action against any party for breach of this Agreement, does not constitute a waiver of such rights, or of future subsequent enforcement of such rights.

21. Notification of Infringement

If You are a copyright owner or an agent thereof and believe in good faith that any content on these Websites infringed Your copyrights, You should send us an infringement notice pursuant to the Digital Millennium Copyright Act ("DMCA"). To file a notice with these Websites, send a written communication to Kreeda's copyrights agent and provide the following information in writing:

- Identification of the copyrighted work that You claim has been infringed.

- Identification of the specific material that is claimed as infringing and information sufficient to permit Kreeda to locate that material on our Websites or within the communication service.

- A statement that You believe, in good faith, that the material referred to was used in a manner not authorized by the copyright owner, its agent, or by law.

- If You are not the copyright owner, a description of Your relationship to the copyright owner.

- Your contact information, including Your address, telephone number and email address.

- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
